Rules That Apply to Severance Pay Calculation

  • Exclusion of Temporary Pay: In order for the calculations to be most accurate, the Employee's Annual Salary should exclude Temporary Pay.
  • Rounding of Service Years: Severance Pay is calculated by rounding up the employee's years of completed, continuous service to the next higher year. If the layoff occurs on the employee's service anniversary date, the calculator may overstate the employee's severance pay.

Additional Factors

Several additional factors can influence the final severance pay amount:

  • Retirement Credit Option: The employee must be full-time, 50 years old or older, and vested in the retirement system in order to be eligible to convert severance benefits to a retirement credit.
  • Health and Life Insurance Premiums: The retirement credit option is estimated by first adding the employee's severance pay, health insurance premium for one year, and life insurance premium for one year. The life insurance premium is calculated as a percentage of the employee's salary and varies from year to year. The employee's health insurance premium varies according to the employee's plan and coverage.
  • Annual Leave Hours: There are limitations on the number of annual leave hours that an employee may be paid.
  • Unemployment Compensation: Employees who are laid off also may be eligible for unemployment compensation benefits. They are not considered in this calculator.
  • Disability Credits: Employees who are laid off and who have Disability Credits may elect to convert those credits to retirement credit.

Basic and Adjusted Severance Pay

The number of years you have worked for your employer significantly impacts your severance pay calculation. Basic severance pay is the initial amount calculated based on your annual rate of basic pay and the number of years you have served your employer. Rate of basic pay does not include additional pay of any other kind.

Adjusted severance pay is the basic severance pay amount adjusted by a factor that accounts for the employee’s age at the time of severance. The age factor plays a significant role in determining the adjusted severance pay. As employees age, the multiplier used in the calculation increases, reflecting the higher value placed on severance for older employees.

Severance Pay Limits and Biweekly Payments

The total severance pay is subject to a maximum limit, ensuring that severance payments do not exceed a predefined cap. Biweekly severance pay is the portion of the total severance pay that you would receive every two weeks.

Severance Pay Allowance

The basic severance pay allowance consists of one week of pay at the rate of basic pay for each full year of creditable service through 10 years, and two weeks of pay for each full year of service beyond 10 years. The rate of basic pay includes the rate of pay fixed by law or administrative action for the position, including applicable premiums such as annual premium pay, law enforcement availability pay, and locality payments.

  • Previous Severance Pay: The worksheet assumes that the employee has not previously received severance pay based on an earlier involuntary separation.
  • Variable Work Schedules: The weekly rate of basic pay for employees with variable work schedules is determined based on the weekly average for the last position held by the employee during the 26 biweekly pay periods immediately preceding the involuntary separation.
  • Age Adjustment Allowance: The basic severance pay allowance is augmented by an age adjustment allowance consisting of 2.5 percent of the basic severance pay allowance for each full 3 months of age over 40 years.
